Commissions and YCHs TOS

I reserve the right to not accept commissions/YCHs. Sorry!

1. Age Requirement.
All commissions/YCHs are STRICTLY 18+, even if the artwork is SFW.
By commissioning me, you are confirming that you are at least 18 years old.

2. Payment.
All payments are to be made via PayPal.
Full payment is required upfront before any work begins.
Final price will be discussed prior to payment, based on the current Commission pricing or YCH cost.
Additional fees/discounts may occur depending on character complexity or art changes.

3. Refund Policy.
No refunds will be issued, with exceptions.
Exceptions include:
(i) The commission/YCH is not completed within 1 month since payment.
(ii) I become unable to complete the artwork due to illness or other extenuating circumstances.
(iii) The requested artwork is too difficult to complete.
Once work has started on a commission/YCH, clause (i) no longer applies, and you will no longer be eligible for a refund.
This prevents abuse where a client could delay responses indefinitely to obtain a partially completed commission for free.

4. Usage Rights.
Clients do not receive commercial rights to the artwork.
Artwork must not be edited, altered, or resold without prior consent.
If the client wishes to use the art commercially, they must notify me before commissioning so appropriate terms can be agreed upon.
You may be blacklisted from Commissions/YCHs if you breach these terms.

5. Content Restrictions.
I will absolutely not create artwork featuring characters that are, or appear to be, minors (under the age of 18).
I will not "Age them up" either.
There are certain kinks I will not draw. Due to the extensive nature of this list, it is not published publicly, but this can be discussed before commissioning. :3.

6. Revisions
MAJOR revisions (e.g. pose changes) can only be done during the "Rough Sketch" phase.
MINOR revisions (e.g. resizing or moving parts) can be done during the "Clean Sketch" phase.
TEENIE TINY revisions (e.g. changing the character's colours or shading colour) can be done after the "Clean Sketch" phase.
MAJOR additional work (e.g. additions not previously discussed, or changes outside the above examples) may incur extra fees.

7. Deadlines.
Commissions/YCHs should be expected to be completed within 10 working days.
If the commission/YCH is not completed within one month after payment, the client may request a refund.
While I aim to complete the commissions/YCHs within 10 working days, delays can occur.

8. Communication
All communications must be transferred over Discord to @TwistCumet in good faith.

Games TOS

1. Age Requirement.
All games are STRICTLY 18+.
By downloading or playing, you are confirming that you are at least 18 years old.

2. User Conduct.
Users must not engage in:
Racism, anti-LGBTQIA+ behaviour, or discrimination.
Hacking or modding.
Use of offensive language beyond general swearing (e.g. "fuck," "shit" are fine; slurs such as the "R-word", "F-slur", and "N-word" are not allowed even if you have the "pass").

3. Refund Policy.
No refunds will be issued.
Games are generally free, but some content may be available exclusively through Patreon.
Patreon may be paused until promised content is delivered.

4. Liability & User-Generated Content.
I will optimise games to the best of my ability, but performance issues (e.g. slow-down & crashing) may still occur.
I'm not liable in situations where there is downtime in online content.
Users are responsible for any content they create or modify within the game.
I am not liable for external, untrusted links or modifications to the game.

5. Intellectual Property.
Game assets must not be ripped, modified, or used without permission.
User-generated content must comply with the User Conduct (Section 2).

6. Game Updates & Online Services
I reserve the right to modify game content and provide updates at my discretion.
Online services may be terminated at any time without prior notice.
Patreon-exclusive servers may be affected, but Patreon itself is for supporting the work rather than purchasing access to services.

7. Data Management
I do not collect any personal data without explicit consent (i.e., providing a survey).
Data that may be kept are: Responses to surveys, contact info (if provided).
In-game, online chat logs may be kept for reports, including the player's IDs.
Absolutely no log-in information is stored remotely or saved when using third-party logins (i.e., Patreon) to games.
Current sessions may be saved locally to the player's device.
I will never request your log-in information, do not provide it to anyone.

8. Dispute Resolution
Any disputes should be communicated calmly over Discord to @TwistCumet in good faith.
